Retirement Plan QDRO for Divorces
Pension and other retirement plans which are divided at
the time of divorce must be divided using a Qualified Domestic Relations
Order ("QDRO.") Using a QDRO will avoid any income taxes at the time of
the division. A QDRO applies to 401(k) plans, government plans, and all
pension plans. Colorado state employees can use a similar plan, called a
DRO.
A QDRO can also be used
to collect past-due child support or maintenance
(alimony.)
